Terms of Service

These Terms of Service ("Terms") govern your access to and use of TotemCRM ("Service"), including the website totemcrm.eu and the application at app.totemcrm.eu. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you have a signed CRM Software Subscription Agreement and Order Form(s) with Totem CRM, that Agreement and the Order Forms govern your subscription to the extent they differ from these Terms.

1. Who we are

2. Use of the Service

You may use the Service only for lawful business purposes. You are responsible for your account, your data, and the way your users use the Service. You must not use the Service to violate any law, infringe others' rights, or distribute malware or spam. We may suspend or terminate access if we reasonably believe you have breached these Terms.

3. Data and privacy

Your data is processed as described in our Privacy Policy. You retain ownership of your data. We process it only to provide and improve the Service and as required by law.

4. Subscription, payment and cancellation

If we offer paid plans, payment terms will be stated at sign-up or in a separate order. You may cancel your account or subscription at any time from the application or by contacting us. Refunds are handled according to the plan or offer you accepted. On cancellation, you may export your data before access is removed; we may delete data after a reasonable retention period as stated in our Privacy Policy.

5. Availability and changes

We strive to keep the Service available but do not guarantee uninterrupted access. We may change, limit, or discontinue features with reasonable notice where practicable. We may update these Terms; we will post the new version on this page and indicate the date. Continued use after changes constitutes acceptance.

6. Liability

The Service is provided "as is". To the fullest extent permitted by law, we exclude liability for indirect, incidental, special, or consequential damages, and our total liability for any claim arising from or related to the Service is limited to the amount you paid us in the twelve (12) months before the claim.

7. Disputes and governing law

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict of laws. Any dispute arising from or related to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts of Lithuania. If you are a consumer, you may also have rights under the laws of your country of residence.
